Terms of Service

1. Acceptance of Terms
By accessing or using PRISMUX's mobile applications, website, and cloud-based streaming services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
2. Description of Service
PRISMUX provides a cloud-based live production platform that enables multi-camera streaming from smartphones. The Service includes:
- Mobile applications for iOS and Android
- Web-based production interface
- Cloud-based video switching and mixing
- Streaming output to third-party platforms (YouTube, Twitch, etc.)
- Cloud recording capabilities (where available)
3. Account Registration
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information as needed
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. Pricing and Payment
Pricing
The Service uses pay-as-you-go hourly pricing. Current tiers and component rates are listed on our pricing page. Prices are subject to change with notice; prepaid credits purchased before a price change are honored at the rates in effect at the time of top-up.
Payment Terms
- Hourly billing: streaming time is billed per started hour. A 45-minute stream counts as 1 hour; a 90-minute stream counts as 2. Billing begins the moment you click Go Live — rehearsal, preview, and camera setup in demo mode are always free.
- No subscription: there are no recurring charges. You pay only for the hours you actually stream.
- Prepaid credits (Cast tier): top-ups may include bonus credits depending on top-up amount. Unused credits expire and are waived two years after the purchase date. All hourly and per-component charges deduct from the credit pool.
- First-stream money-back guarantee: if you are not satisfied with your first live stream, contact us and we will issue a full refund of that session. This guarantee applies once, solely to your first paid live stream — it does not extend to any subsequent sessions, top-ups, or other charges.
- All other fees and credits are non-refundable except as required by law.
Cancellation and Account Closure
Because billing is pay-as-you-go, there is no subscription to cancel. You may stop using the Service at any time without notice. Unused prepaid credits remain usable until their two-year expiry from the original top-up date and are waived thereafter. Credits are not cash-refundable.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Stream content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Stream content that depicts violence, sexually explicit material, or hate speech
- Impersonate any person or entity
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any systems
- Use the Service for any illegal or unauthorized purpose
We reserve the right to suspend or terminate accounts that violate these terms.
6. Content and Intellectual Property
Your Content
You retain ownership of all content you stream through the Service ("Your Content"). By using the Service, you grant us a limited license to process, transmit, and store Your Content as necessary to provide the Service.
Our Intellectual Property
The Service, including its design, features, and functionality, is owned by PRISMUX and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
Third-Party Platforms
When streaming to third-party platforms (YouTube, Twitch, etc.), your streams are subject to those platforms' terms of service. You are responsible for compliance with their policies.
7. Privacy and Data Protection
Our Privacy Policy describes how we collect, use, and protect your information. By using the Service, you agree to our data practices as described in the Privacy Policy.
We process personal data on the lawful basis of contract performance (to provide the Service), legitimate interests (to improve and secure the Service), and where applicable, your consent.
For users in the European Economic Area (EEA), UK, or Switzerland: You have rights under the General Data Protection Regulation (GDPR) including the right to access, rectify, erase, restrict processing, data portability, and to object to processing. You also have the right to lodge a complaint with your local data protection authority. To exercise these rights, contact us at privacy@prismux.com.
8. International Data Transfers
PRISMUX is based in the United States and operates globally. Our cloud infrastructure is hosted in data centers located in the United States, European Economic Area (EEA), and Singapore. Your data may be transferred to, stored, and processed in any of these regions depending on your location and service configuration.
For transfers of personal data from the EEA, UK, or Switzerland, we rely on:
- The EU-U.S. Data Privacy Framework (DPF), including the UK Extension and Swiss-U.S. DPF
- Standard Contractual Clauses (SCCs) approved by the European Commission where DPF does not apply
- The UK International Data Transfer Addendum for UK-specific transfers
Our infrastructure providers maintain SOC 2 Type 2 certification with security controls covering confidentiality, availability, and data protection across all regions.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Live streaming involves inherent risks including network issues, latency, and platform outages. We are not responsible for streaming failures beyond our reasonable control.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRISMUX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless PRISMUX and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination:
- Your right to use the Service immediately ceases
- We may delete your account and associated data
- Provisions that should survive termination will remain in effect
13. Governing Law
These Terms are governed by the laws of [Jurisdiction to be specified], without regard to conflict of law principles. Any disputes shall be resolved in the courts of [Jurisdiction to be specified].
For EU/EEA users: Nothing in these Terms affects your statutory rights as a consumer under applicable EU law. If you are a consumer residing in the EU, you may also bring proceedings in the courts of your country of residence.
14. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and PRISMUX regarding the Service.
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver: Failure to enforce any right does not constitute a waiver of that right.
- Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations freely.
